Or if it be known that the ox hath used to push in time past, and his owner hath not kept him in; he shall surely pay ox for ox; and the dead shall be his own.

One Bible Commentary on Exodus 21: 36

1

Ex. 21:12-36
#60: Not to smite a father or a mother (Ex. 21:15)
#279: Not to kidnap any person of Israel (jewfaq gives the reference as Ex. 20:13, The Owner’s Manual gives the reference as Ex. 21:16) (according to the Talmud, this verse refers to stealing a person, distinguished from Lev. 19:11, regarding the taking of property)
#298: To adjudge a thief to pay compensation or (in certain cases) suffer death (Ex. 21:16; Ex. 21:37 (typo); Ex. 22:1)
#61: Not to curse a father or mother (Ex. 21:17)
#299: That he who inflicts a bodily injury shall pay monetary compensation (Ex. 21:18-19)
#285: That the Court shall pass sentence of death by decapitation with the sword (Ex. 21:20; Lev. 26:25)
#162: Not to eat the flesh of an ox that was condemned to be stoned (Ex. 21:28)
#233: To judge cases of damage caused by an uncovered pit (Ex. 21:33-34)
#234: To judge cases of injuries caused by beasts (Ex. 21:35-36)
Commands #60 and #61 go with #59 which is also the 5th of the Ten Commandments (To honor father and mother).
Command #279 is sandwiched between the two above. According to jewfaq, it goes with #278 which is also the 6th of the Ten Commandments (Not to slay an innocent person). It seems that kidnapping is on par with murder. Or it just may be an oversight.
Commands #298, #299, & #285 are similar in that the guilty must pay compensation. They are considered not applicable because a theocratic state of Israel is not in existence.
Verse 22 is not referenced within the 613 commands, however it is one of the proof texts given for Pro-Life/Anti-Abortion. Translations that are paraphrased usually state that the injured woman miscarried which is specific to the death of an infant. However, I prefer translations that are more word-for-word which are vague on the issue. NASB states that “she gives birth prematurely”, so the infant may or may not have survived. This point seems to go with the phrases that follow after it: “yet there is no injury” and then “if there is further injury”.
Command #162 is a kosher law. An animal that was stoned would not have been probably drained of blood. Also, no one should benefit from a tragedy.
Commands #233 & #234 are cases of negligence. They are not applicable for the same reasons as #298. But just cause some commands aren’t applicable doesn’t mean a modern government can’t have similar laws on the books.
